Understanding Our Service Terms and Conditions

1. Acceptance of Terms

By accessing and using the ApnaDoc website, mobile application, and healthcare services, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, please do not use our services.

ApnaDoc reserves the right to modify these terms at any time. Continued use of our services following any changes constitutes acceptance of the modified terms. We will notify you of significant changes through email or website notice.

Important: These terms apply to all users of ApnaDoc services including patients, account holders, and website visitors.

2. Service Description

ApnaDoc provides the following healthcare services:

  • Doctor at Home: Home visit consultations with certified MBBS doctors
  • Lab Test at Home: Blood sample collection and diagnostic testing
  • Nurse at Home: Professional nursing care including IV administration, injections, and wound care
  • Health Checkups at Home: Comprehensive annual health screening and examination
  • Vaccination at Home: Immunization services at your home with proper documentation
  • Elder Care at Home: Specialized care for senior citizens

These services are provided in the Noida, Greater Noida, and Indrapuram areas of Uttar Pradesh, India.

2.1 Service Hours

Most services are available 24/7, subject to availability and scheduling. Some specialized services may have specific hours. Availability will be confirmed during booking.

2.2 Service Area

Services are available in Noida, Greater Noida, and Indrapuram. Service availability in specific locations will be confirmed at the time of booking.

3. User Eligibility

By using ApnaDoc services, you represent and warrant that:

  • You are 18 years of age or older (or parents/guardians for minors)
  • You have the legal right to enter into this agreement
  • You reside in our service area (Noida, Greater Noida, or Indrapuram)
  • The information you provide is accurate and complete
  • You are not prohibited from receiving healthcare services
  • You comply with all applicable laws and regulations

3.1 Minors

Users under 18 years must have parental or guardian consent to use ApnaDoc services. Parents/guardians are responsible for the minor’s use of the platform.

4. User Account and Registration

4.1 Account Creation

To use ApnaDoc services, you may need to create an account. You must provide accurate, complete, and current information. You are responsible for maintaining confidentiality of your login credentials.

4.2 Account Responsibility

You are responsible for:

  • Keeping your password secure and not sharing it
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access
  • Logging out properly, especially on shared devices

4.3 Account Termination

ApnaDoc reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or use the service improperly.

5. Booking and Appointment Policy

5.1 Booking Procedure

You can book services through our website, mobile app, phone, or WhatsApp. Bookings are subject to availability and confirmation by ApnaDoc.

5.2 Appointment Confirmation

Once you book an appointment, you will receive a confirmation via SMS and email with:

  • Appointment date and time
  • Service provider name (if applicable)
  • Price and payment details
  • Important instructions

5.3 Appointment Rescheduling

You can reschedule appointments at least 4 hours before the scheduled time. Rescheduling is subject to availability. ApnaDoc may charge a rescheduling fee in certain cases.

5.4 No-Show Policy

If you miss an appointment without canceling at least 4 hours in advance, ApnaDoc may charge a cancellation fee or forfeit your advance payment. Multiple no-shows may result in service suspension.

5.5 Service Availability

ApnaDoc does not guarantee service availability for specific time slots. We will make reasonable efforts to honor your preferred timing, but scheduling is subject to staff availability.

6. Cancellation and Refund Policy

6.1 Cancellation by User

You may cancel your appointment:

  • 4+ hours before: Full refund of payment
  • 2-4 hours before: 50% refund of payment
  • Less than 2 hours: No refund (service fee retained)

6.2 Cancellation by ApnaDoc

ApnaDoc may cancel appointments due to:

  • Service provider unavailability
  • Emergency situations
  • Weather or natural disasters
  • User violation of terms

In case of ApnaDoc-initiated cancellation, you will receive a full refund within 3-5 business days.

6.3 Refund Processing

Refunds are processed to the original payment method within 3-5 business days. Bank processing times may add additional days. Refunds cannot be given in cash.

6.4 Non-Refundable Items

Service fees, convenience charges, and delivery charges are non-refundable unless the service cannot be provided by ApnaDoc.

Important: Refund eligibility is subject to these terms. Special packages and promotional offers may have different cancellation policies.

7. Payment Terms

7.1 Payment Methods

ApnaDoc accepts the following payment methods:

  • Credit/Debit cards (Visa, Mastercard, American Express)
  • UPI (Google Pay, PhonePe, Paytm)
  • Net Banking
  • Mobile Wallets
  • Cash on delivery (in select cases)

7.2 Pricing

All prices are displayed in Indian Rupees (INR) and include applicable taxes unless otherwise stated. ApnaDoc reserves the right to change prices with 7 days’ notice.

7.3 Additional Charges

Additional charges may apply for:

  • Service in emergency hours (if applicable)
  • Specialized services or procedures
  • Extended consultations
  • Travel outside standard service area

All additional charges will be communicated before confirming the booking.

7.4 Payment Security

All payments are processed through secure, PCI-DSS compliant payment gateways. ApnaDoc does not store credit card information on its servers.

7.5 Failed Payments

If payment fails, your appointment will not be confirmed. You may retry payment or contact support for assistance.

8. User Obligations and Conduct

As a user of ApnaDoc services, you agree to:

8.1 Provide Accurate Information

  • Provide truthful and complete personal information
  • Disclose all relevant medical history and current health conditions
  • Inform healthcare providers of allergies and medications
  • Update your information if it changes

8.2 Conduct Standards

You must NOT:

  • Use abusive or harassing language toward our staff
  • Discriminate based on protected characteristics
  • Attempt to hack or damage our systems
  • Share your account with unauthorized persons
  • Use services for illegal purposes
  • Violate any applicable laws or regulations

8.3 Patient Responsibility

  • Follow healthcare provider recommendations
  • Prepare for appointments as instructed
  • Provide a safe environment for service delivery
  • Report any complications or concerns promptly
  • Keep medical appointments and pay fees on time

8.4 Right to Refuse Service

ApnaDoc reserves the right to refuse or discontinue service to users who:

  • Are abusive or threatening toward staff
  • Violate these terms
  • Provide false information
  • Engage in harassment or discrimination
  • Create unsafe situations

9. Medical Disclaimer

Important Medical Disclaimer: The information and services provided by ApnaDoc are for informational and medical purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

9.1 Not Emergency Service

ApnaDoc services are NOT emergency medical services. For life-threatening emergencies, please call emergency services (108 or 102 in India) immediately. Do not rely on ApnaDoc for emergencies.

9.2 Doctor-Patient Relationship

A doctor-patient relationship is established when ApnaDoc’s healthcare provider begins consultation with you. This relationship does NOT create an obligation for continuous care or guarantee specific outcomes.

9.3 Self-Care Responsibility

You are responsible for following medical advice provided by healthcare professionals. ApnaDoc is not responsible for outcomes resulting from non-compliance with medical recommendations.

9.4 Second Opinion

ApnaDoc recommends consulting with multiple healthcare providers for serious health concerns. The opinions and treatments provided are based on the information available at the time of consultation.

9.5 Medication Disclaimer

ApnaDoc healthcare providers prescribe medications based on clinical assessment. You must:

  • Inform about all current medications and supplements
  • Disclose any medication allergies
  • Follow dosage instructions carefully
  • Report any adverse reactions immediately

9.6 No Medical Guarantee

ApnaDoc does not guarantee specific medical outcomes. Healthcare results depend on individual factors including patient compliance, health conditions, and lifestyle.

10. Limitation of Liability

10.1 Disclaimer of Liability

To the fullest extent permitted by law, ApnaDoc shall NOT be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profit, revenue, data, or business opportunities
  • Damages from service delays or unavailability
  • Medical complications or unfavorable health outcomes
  • Third-party actions or negligence
  • Loss or damage to personal property

10.2 Maximum Liability

ApnaDoc’s maximum liability under any circumstance shall not exceed the amount you paid for the specific service in question.

10.3 Service “As-Is”

ApnaDoc services are provided “as-is” without warranties of any kind. We make no guarantees about service quality, availability, or suitability for specific purposes.

10.4 Healthcare Provider Liability

Healthcare providers are independent professionals. ApnaDoc is not responsible for their negligence, malpractice, or misconduct, though we maintain professional standards and verification processes.

Important: Some jurisdictions do not allow liability limitations. These limitations apply to the fullest extent permitted by applicable law.

11. Warranties and Disclaimers

11.1 Disclaimer of Warranties

ApnaDoc and its services are provided “as-is” and “as-available” without any warranties, express or implied, including:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, completeness, or non-infringement
  • Warranties regarding service quality or availability
  • Warranties regarding health outcomes

11.2 Service Interruptions

ApnaDoc does not warrant that:

  • Services will be uninterrupted or error-free
  • Defects will be corrected
  • Services will meet your specific requirements
  • Service providers will be available at specific times

11.3 Third-Party Content

ApnaDoc is not responsible for third-party websites, links, or services. Accessing external websites is at your own risk.

12. Intellectual Property Rights

12.1 ApnaDoc Content

All content on the ApnaDoc website and app, including text, images, logos, graphics, and videos, is owned by or licensed to ApnaDoc and protected by copyright laws.

12.2 Limited License

You are granted a limited, non-exclusive, non-transferable license to access ApnaDoc content for personal, non-commercial use only.

12.3 Prohibited Uses

You may NOT:

  • Reproduce, distribute, or transmit content without permission
  • Modify or create derivative works
  • Remove copyright or proprietary notices
  • Use content for commercial purposes
  • Reverse engineer or decompile our software

12.4 Your Content

You retain ownership of information you submit, but grant ApnaDoc the right to use it to provide and improve services.

13. Termination

13.1 Termination by User

You can terminate your ApnaDoc account at any time by contacting us. Upon termination, your medical records will be retained per legal requirements but your account access will be disabled.

13.2 Termination by ApnaDoc

ApnaDoc may terminate your account or services immediately if you:

  • Violate these terms
  • Engage in illegal activity
  • Threaten or abuse staff
  • Provide false information
  • Fail to pay fees
  • Create safety risks

13.3 Effect of Termination

Upon termination:

  • Your account access will be disabled
  • Medical records will be retained per legal requirements
  • Outstanding payments remain due
  • These terms survive termination

14. Dispute Resolution and Governing Law

14.1 Governing Law

These terms are governed by the laws of India, specifically the laws of Uttar Pradesh. You agree to submit to the exclusive jurisdiction of courts in Noida, Uttar Pradesh.

14.2 Informal Resolution

Before initiating legal proceedings, we encourage you to:

  • Contact us directly with your concern
  • Provide details of the dispute
  • Allow 30 days for resolution attempts
  • Work toward a mutually acceptable solution

14.3 Legal Proceedings

If informal resolution fails, disputes shall be resolved:

  • Jurisdiction: Courts in Noida, Uttar Pradesh, India
  • Applicable Law: Laws of India and Uttar Pradesh
  • Venue: Courts located in Noida, Uttar Pradesh

14.4 Consumer Protection

If applicable, consumer protection laws of India provide additional protections. You may file complaints with consumer protection authorities if services are defective or unsafe.

14.5 Indemnification

You agree to indemnify and hold ApnaDoc harmless from any claims, damages, or liabilities arising from your violation of these terms or misuse of services.

General Provisions

Entire Agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and ApnaDoc regarding your use of our services.

Severability

If any provision of these terms is found invalid or unenforceable, that provision will be limited to the minimum extent necessary, and remaining provisions will continue in full effect.

Waiver

Failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign these terms to anyone. ApnaDoc may assign these terms to successor companies or entities.

Notice

ApnaDoc may send notices via email or posting on the website. You agree to accept notices in this manner.
